JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Virendra Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 30-03-2017 in Case No. C2-194 of 2017 registered for offence under Section 30(A) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.
Learned counsel for the petitioner submits that petitioner has been made accused on an accusation that petitioner was carrying about 30 liters of Nepali wine. Learned counsel for the petitioner, by way of referring to paragraph - 3 of the petition, submits that petitioner is having clean antecedent and he has remained in custody sufficiently.
Considering the nature of accusation, clean antecedent
Patna High Court Cr.Misc. No.41770 of 2017(2) dt.15-09-2017 2/2 as well as period of custody, let the petitioner namely Kamlesh Manjhi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II-cum-Special Judge Excise Act, Sitamarhi in connection with Case No. C2-194 of 2017.
