In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 420, 472, 473,, 474, 468 and 467 of the I.P.C. Allegedly, the co-accused Babu Ram Yadav got executed a sale deed in his favour on 01.10.2002 wherein the petitioner is identifier and it is alleged that by committing forgery the said sale deed was executed for the share of land of the complainant also.
Submission is that the case has been lodged after ten years. The dispute is purely of civil nature and co-accused Babu Ram Yadav has been allowed pre-arrest bail vide order dated
Patna High Court Cr.Misc. No.21138 of 2015 (2) dt.16-07-2015 2/2 22.01.2015 in Cr. Misc. No. 30383 of 2014 and other co-accused have also been allowed pre-arrest bail and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. does not oppose.
In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Saharsa in Saharsa Sadar P.S. Case No. 400 of 2012, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
