JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 06-12-2017 The petitioner draws attention of the Court towards the merit list dated 9.12.2013, issued by respondent no.5 pursuant to which her application for appointment/engagement on the post of Anganbari Sevika in Ward No.2, Anganbari centre Musaharwa Centre code no.1, Panchayat Bhelahi, Police Station Palanwa, District East Champaran, has been rejected.

Counter affidavit has been filed by the State submitting that the petitioner's application has been rejected on the ground that one member of her family, being Bhabhi (sister-in-law) was an employee working as Panchayat teacher earning Rs.9,300/- from the Education

Patna High Court CWJC No.11169 of 2014 dt.06-12-2017 /2 Department. In this regard, he refers to the provisions contained in clause 4/4.9 of the Anganbari Sevika/Sahaika Selection Guidelines under which his candidature was ineligible for appointment. A copy of the same is as Annexure A to the counter affidavit. Clause 10/10.3 of the Guidelines provides the remedy of an appeal to the petitioner, which has not been availed by her.

In view of the above discussions, the writ petition is dismissed.
