Petitioners pray for bail in a case registered for the offence under Sections 272, 273, 328, 307, 302, 341, 120(B) of the Indian Penal Code and Sections 30(a), 30(c) and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Petitioners are alleged to have indulged in sale of spurious liquor and on search, from the shop of petitioners, two bottles of 375 ml. and 180 ml. of whisky were found. It is submitted that no spurious liquor has been recovered from the conscious possession of petitioners and only on suspicion, petitioners have been made accused in this case. Petitioners have clean antecedent and are in custody since 21.11.2021. Investigation is complete.

Patna High Court CR. MISC. No.15398 of 2022(2) dt.13-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody and clean antecedent of petitioners, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Court No. II, Muzaffarpur in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 730 of 2021.
