2. Upon query of the Court that who are the persons through whom petitioner moved before this Court? Counsel for the petitioner submits that the petitioner according to paragraph no.15, has shown himself as Secretary of the Shri Mahedra Nath Shiv Mandir Trust Committee but upon perusal, it transpires to this Court that in paragraph no.15, the name of the Secretary is "Col. Deo Narayan Singh" but in the writ petition, the name of the Secretary is "Narendra Dev Narayan Singh".
3. In the opinion of this Court Col. Deo Narayan Singh and Narendra Dev Narayan Singh are two different persons, therefore, Court is not inclined to further entertain this writ petition.
4. It is also made clear that the institution of Shri
Patna High Court CWJC No.7800 of 2015(2) dt.17-07-2023 2/2 Mahendra Nath Shiv Mandir Samiti was constituted only for five years and it came into existence on 31.08.2010 and it was valid upto 31.08.2015, presently year 2023 is going on which is beyond the scope of the valid existence of the said Samiti.
5. In this view of the matter, this writ petition is hereby dismissed as having become infructuous. But liberty is hereby granted that Mandir Samiti may sue the present Samiti through the present Secretary of existing Samiti. (Dr. Anshuman, J.) Ashishsingh/- U
