JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Section 395 of the Indian Penal Code. Prosecution case is that on 17.11.2014 while informant was coming back to his village, he was looted away by criminals and thereafter criminals looted away cash from other passengers of several vehicles also. Petitioners' name has come on the confession of co-accused.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have falsely been implicated in the present case. There is no substantive evidence to implicate the petitioners in the present case.

On behalf of the State, it is submitted that petitioners are not named in the F.I.R. and their name has come in course of investigation. Other co-accused have been granted regular bail vide Cr. Misc. no. 26353 of 2015, Cr. Misc. no. 42645 of 2015 and Cr. Misc. no. 52 of 2016.

Considering the aforesaid facts and circumstances, I am

Patna High Court Cr.Misc. No.15936 of 2016 (2) dt.16-05-2016 2/2 not inclined to grant anticipatory bail to the petitioners, same is rejected.

Any how, if petitioners surrender in the court below, i.e., learned S.D.J.M., Jehanabad, in connection with Parasbigha P. S. Case no. 141 of 2014 within a period of six weeks from the date of receipt of a copy of this order and pray for regular bail, same shall be considered and disposed of taking into account that other coaccused have already been granted regular bail without being prejudiced by this order.
