Petitioner is languishing in judicial custody since 08.03.2018 in connection with Lauriya P.S. Case No. 23 of 2018 for offences punishable under Sections 147, 149, 341, 342, 323, 307, 332, 353, 224, 504, 506 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that while the police searched the house of one Awadhesh Paswan regarding kidnapping in connection with Lauriya P.S. Case No. 345 of 2017, the petitioner along with 12 other co-accused assaulted the police personnel and injured them.

It has been submitted by the learned counsel for the petitioner that he is innocent, general and omnibus allegations have been levelled against him and some of the co-accused have been granted pre-arrest bail by co-ordinate Benches of this Court. He submits that the present case reveals the highhandedness attitude of the police personnel.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st Bettiah, District-West Champaran in connection with Lauriya P.S.
