JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 12-08-2015 Indulgence was granted to the petitioner by order dated 20-5-2014 passed in Cr. Misc. No. 11388 of 2014 in which it was observed that upon submission of charge-sheet, if any, the petitioner would surrender before the court below, and pray for bail. The charge-sheet having been filed, the petitioner has not moved the trial court for bail, rather has come here again directly.
2. This application is, thus, not maintainable. However, as the petitioner has been charge-sheeted , he must surrender in the court below, and pray for bail, which would be considered by the trial court on its own merits, preferably on the same day, in view of the fact that the petitioner is a retired Headmaster and is ill.
