JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 332, 333,337, 307, 427, 435, 353 and 379 of the Indian Penal Code and 3/4 of The Prevention of Damage to Public Property Act,1984.
The prosecution case is that on 21.12.2015 at 11.30 a.m., one electrician namely Ajeet Kumar @ Laloo Yadav got electrocuted when the informant being police officer went to the place of occurrence and tried to pacify the mob, the mob of 200250 people blockade the road, raised slogan against the government, broke the gate of the police station and started pelting stones causing injuries to the police personnel. The mob also put
Patna High Court Cr.Misc. No.16704 of 2016 (2) dt.19-04-2016 2/2 the government vehicle on fire. The informant claimed to identify 42 persons among the mob, are named in the FIR and 250 unknown. The petitioner was not named in the First Information Report.
Accusation is against the mob. The mob was demanding compensation but the police in order to save their own skin lodged the preset case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Co-accused Santosh Singh has been granted anticipatory bail vide Criminal Miscellaneous No.11964/2016 by a co-ordinate Bench of this Court.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Arwal in connection with Kurtha P.S. Case No.170/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
