The matter has been taken up through video conferencing.
The petitioners apprehend their arrest in Naubatpur PS case No. 693/2019 registered under Section 341, 323, 337, 379, 354, 504, 307/34 of the IPC.
The informant alleged that on 26.10.2019 at about 8.45 PM her next door neighbour, Ramakant and Ravi Kumar started abusing the informant standing in front of her house. When the informant came out from her house and asked the reason for using filthy language, Ravi Kumar caught hair of Sunita Kumari, daughter of the informant, and dragged her towards his house. Ramakant was asking to kill her. Ravi Kumar assaulted the informant with iron rod on her head and the informant got fracture injury on her head. Other accused persons
Patna High Court CR. MISC. No.16529 of 2020(3) dt.21-06-2021 2/2 also assaulted the informant and Ravi Kumar snatched chain made of gold from the neck of daughter of the informant. The learned counsel for the petitioners submits that petitioners are innocent and in fact they have committed no offence. The petitioners have falsely been implicated in the case on account of some petty dispute. The petitioners are neighbours. There is counter version being Naubatpur PS case No. 692/2019. From the side of the petitioners many persons were treated in PMCH and the prescription of doctors are annexed as Annexure-4 series, therefore, the petitioners deserve anticipatory bail but it appears from the allegations made by the informant that the petitioners came in front of the house of the informant and began to use filthy language.
When the informant objected they assaulted Sunita Kumari and Sunita Kumari got lacerated wound above her right eye. The informant was also assaulted and she is alleged to have got fracture injury on her head. From perusal of the injury report of the petitioners, it appears that the doctor only prescribed some medicines but did not find any external or internal injury on their body Taking into consideration the facts aforesaid and the fact that the petitioners are assailants of the ladies, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
