26-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in relation to Kotwali (Adampur) P.S. Case No. 85 of 2016 registered under Sections 409 & 420 of the Indian Penal Code.

It is, inter alia, alleged that for the purposes of inquiry, as to the validity of appointment of Shiksha Mitra/Panchayat Teacher, petitioner being Panchayat Secretary did not cooperate and submit necessary papers.

Learned counsel for the petitioner states that he was not Panchayat Secretary at the time when

Patna High Court Cr.Misc. No.15830 of 2016 (2) dt.26-05-2016 those appointments were made. However, papers have been subsequently recovered and submitted.

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Duryodhan Singh, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Adampur) P.S. Case No. 85 of 2016, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
