JUSTICE SANJAY KUMAR ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned A.P.P. for the State. The petitioner seeks regular bail in connection with Udwant Nagar P.S. Case No.257 of 2017 registered for the offences punishable under Sections 304(B) and 201 of the Indian Penal Code.

It is alleged that the informant had married his daughter with the petitioner on 05.07.2017 and his daughter was killed on 28.08.2017 by the petitioner and his family members when the demand of dowry was not fulfilled.

It has been submitted that the daughter of the informant was suffering from stomach pain and due to that she died and so her dead body was disposed of. He further submits

Patna High Court Cr.Misc. No.29383 of 2018 (3) dt.28-06-2018 that no demand of dowry was made by the petitioner and his family members. The allegation against the petitioner and his family members is omnibus.

The learned A.P.P. for the State opposed the submission.

The petitioner is husband of deceased. As per allegation, the deceased was killed within fifteen months of her marriage by her husband and in-laws as the demand of motorcycle was not fulfilled. The dead body of deceased was disposed of without any information to the family members of deceased. During investigation, a large number of witnesses have supported the allegation of murder of deceased by the petitioner and his family members.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer of bail is accordingly rejected.
