The petitioner seeks bail in a case registered under Sections 387, 147, 506 of the Indian Penal Code and Sections 17, 20, 21 of U.A.P. Act.
Allegation is that construction of bridge was going on village Dhamni in which contractor Vijay Singh was working as clerk. On 21.12.2019 at 10.30 p.m. seven unknown miscreants came at the site of construction work and said to stop the work and asked to pay levy of 7% to 10% on pad of C.P.I. (Maoist). It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.12.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the
Patna High Court CR. MISC. No.14716 of 2020(2) dt.03-03-2020 2/2 present case. The petitioner is not named in the F.I.R. His name has come on disclosure made by one Surendra Yadav. The petitioner has been made accused due to mistake of fact. The participation in the alleged occurrene is denied by the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Rajauli P.S. case No.439 of 2019.
