In this case, the petitioner is apprehending his arrest in connection with Shyampur Bhataha P.S. Case No. 130 of 2018 registered for offences under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

In the present case, the police has recovered total about 33.15 liters of foreign liquor from the orchard of one Shaligram Singh.

On seeing the police, out of five accused persons, three accused persons got success in fleeing away from the place of occurrence but, two of them were caught hold by the police who disclosed the name of the present petitioner.

Patna High Court CR. MISC. No.15011 of 2019(2) dt.12-03-2019 2/2 The petitioner has got no criminal antecedent. Looking to the quantity of liquor recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will take a decision in accordance with law.
