Ms. Alka Verma, AC to SC 17 ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 24-09-2019 Petitioner and the respondent authorities are at Loggerheads as to whether or not the petitioner had presented the appeal before the authorities.
In spite of specific opportunity granted earlier the State has come out with a response that the appellate authority has not received any information from the branch competent to receive petitioner's appeal nor from the Distribution Branch. Such stand does not answer the specific query of the court whether the petitioner has presented the appeal or not. At best it shows that the appellate authority is not in knowledge of the same.
Patna High Court CWJC No.12903 of 2014(6) dt.24-09-2019 2/2 In stead of protracting this matter any further to ascertain the fact, this Court would consider it appropriate to direct the appellate authority to consider petitioner's appeal which has been placed on record as Annexure 12 in the supplementary affidavit filed by the petitioner on its merit and pass a reasoned and speaking order on the said appeal of the petitioner. Respondent No. 2 should consider the same and dispose it of in accordance with law expeditiously without any undue delay preferably within three months from the date of receipt/production of a copy of this order.
The writ petition stands disposed of.
