JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mahnar Police Station Case No. 285 of 2014 registered for the offences punishable under Section 420 and 486 of the Indian Penal Code and Section 63 of the Copy Right Act.

Some duplicate books are said to have been recovered from the business premises of the petitioners. Admittedly, the offence is punishable under Copy Right Act . The submission on behalf of the petitioners is that section 420 and 486 of the Indian Penal Code have wrongly been inserted in this case and as a matter of fact, no case under section 420 and 486 of the

Patna High Court Cr.Misc. No.21106 of 2015 (2) dt.03-07-2015 2/2 Indian Penal Code is made out.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali in Mahnar Police Station Case No. 285 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
