JUSTICE RAVI RANJAN ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 120B of the Indian Penal Code and Sections 30 (A), 32 (2), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 400 litres of country-made liquor were recovered from the Tata Sumo Vict which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 09.01.2017.

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on

Patna High Court Cr.Misc. No.34361 of 2017(2) dt.10-08-2017 2/2 bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 10 of 2017 with a condition that one of the bailors will be the resident of Bihar since the petitioner belongs to Jharkhand. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
