04-05-2018 Heard Sri Y.C.Verma, learned senior counsel assisted by Sri Parmanand Prasad Narain Sahi, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Jamui P.S. Case No. 318 of 2016 registered for offence under Sections 25(1-B)A, 26 of the Arms Act, 1959, has prayed for grant of bail.
Learned senior counsel for the petitioner, at the very outset, has drawn my attention to statement made in paragraph -3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner has falsely been implicated on an accusation as if in the dickey of one motorcycle, which was found by the police, there was one pistol
Patna High Court Cr.Misc. No.27042 of 2018(2) dt.04-05-2018 2/2 loaded with two live cartridges. It was alleged that petitioner alongwith one another accused fled away and petitioner's name has come, since from the dickey of the seized motorcycle, photocopy of one voter card and one electric bill in the name of petitioner were found.
Be that as it may, considering the nature of accusation and clean antecedent of the petitioner, let the petitioner namely Singheshwar Mahto @ Singheshwar Mahton @ Sidheshwar Mahto be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S.
