JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 Heard the parties. Earlier prayer for bail of the petitioner has been rejected by this Court on merit vide Annexure-1 with observation to the trial court to expedite the trial. The petitioner has filed this application as he is in custody for more than fifteen months.
Heard learned A.P.P. also.
From perusal of the report it appears that all the witnesses have been examined except I.O. and the doctor. In such view of the matter, I am not inclined to grant bail to the petitioner at this stage. However, the trial court is
Patna High Court Cr.Misc. No.43578 of 2017 (3) dt.08-11-2017 2/2 directed to expedite the trial and try to conclude it within a period of four months and at the same time the Superintendent of Police, Sitamarhi is directed to ensure the presence of the witnesses of this case and if not concluded, the petitioner is at liberty to move the trial court itself who will consider and pass an order on its own merit and the petitioner shall cooperate in the disposal of the trial.
With the aforesaid observation, this application is dismissed.
