2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bettiah Town P.S. Case No. 283 of 2023 instituted for the offence under Sections 182, 193, 196, 198, 418, 420, 405, 467, 468, 469 and 471 of the Indian Penal Code.
3. The case of the prosecution based on complaint petition is that the land prescribed in complaint petition was purchased by Late Madan Lal Agrawal, the grandfather of the complainant from Kedarnath Motani and Bala Prasad Motani. The above land was given in the share of the complainant by partition. It is further alleged that this land has been mutated in

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. It has been submitted that there is land dispute between the parties. Both parties are claiming the said land and each complainant has contested the case before the revenue authorities and has also filed CWJC No. 3403 of 2023 before the Hon'ble Court and after filing of the CWJC, he has filed this case only to harass the accused. From perusal of the complaint itself, it is clear that it is out and out civil dispute between the parties.
5. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Bettiah Town P.S. Case No. 283 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-
Patna High Court CR. MISC. No.14769 of 2025(2) dt.19-04-2025 3/3 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
