The petitioners seek bail in connection with Supplementary Maheshkhunt P.S. Case No. 116 of 2016 dated 16.12.2016 instituted for the offences under Sections 302 and 34 of the Indian Penal Code.

The petitioners along with others are said to have assaulted the brother of the informant by means of Lathi and Khanti leading to his death. The deceased is said to have suffered one vital injury leading to his death.

Taking into account the fact that there are general and omnibus allegations against many accused persons, Yogo Yadav @ Yogo @ Yogendra Yadav @ Jago Yadav @ Jogendra Yadav has been granted bail by a Bench of this Court in Cr. Misc. No. 26061 of 2017 by order dated 20.07.2017.

Patna High Court Cr.Misc. No.48680 of 2017 (3) dt.27-11-2017 The petitioners are in custody since 18.08.2017. Regard being had to the aforesaid facts, the petitioners are directed to be released on bail on furnishing their bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IIIrd, Khagaria in connection with Maheshkhunt P.S. Case No. 116 of 2016 on the following conditions:- (i) That one of the bailors shall be a close relative of the petitioners.

(ii) That the petitioners shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, their bail bonds shall be liable to be cancelled by the learned court concerned. (iv) The petitioners shall cooperate with the investigation, if not already concluded, and make themselves available as and when required and in case of failure, the State shall be at liberty to move for cancellation of bail.
