The petitioners apprehend their arrest in Bairginiya P.S. Case No. 213/2015, registered for the offences punishable under Sections 147, 148, 149, 447, 448, 323, 324, 307, 379, 504, 506, 427 of the Indian Penal Code and Section 27 of the Arms Act. The allegation against the petitioners is that petitioner no. 1 Satish Kumar@ Satish Kumar Das @ Chote and petitioner no. 2 Shashank Shekhar @ Madhav assaulted the informant and his son. Petitioner no. 1. assaulted with spade and petitioner no. 2 assaulted with axe on the head of the informant, but the injuries found on the person of both the injured are simple in nature. It is submitted that other co-accused who are also

Patna High Court Cr.Misc. No.16095 of 2016 (2) dt.02-05-2016 2/2 alleged to have been assaulted the informant and his son have already been granted anticipatory bail vide order passed in Cr. Misc. 12295/2016 by a Coordinate Bench of this Court. Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bairginiya P.S. Case No. 213/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
