Mr. Anand Mohan Prasad Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-09-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

The crux of the allegation is that the informant was talking with someone about the marriage of his daughter, several accused persons including the petitioners came there with pistol in their hands and co-accused Ankuar Kumar fired upon the informant which hit none and on the gun point, they looted Rs.5,50,000/- from his house.

It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No. 15342 of 2022(2) dt.12-09-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that specific allegation against co-accused Ankur Kumar and not against these petitioners and no stolen money was recovered from the possession of the petitioners. He further submits that similarly situated co-accused persons have already been granted anticipatory bail by this Court passed in Cr. Misc. No. 6799 of 2022.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Bhagwanpur (Tiyay) P.S. Case No. 115 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
