JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Sitamarhi (Mehsaul OP) P.S. Case No. 448 of 2019, registered under Section 25(1-b)a, 26/35 of the Arms Act. The accusation is that on receiving the secret information about moving of Pintu Singh, who is accused in Mejarganj P.S. Case No. 107 of 2019 and Suppi P.S. Case No. 130 of 2019, towards Bhagalpur boarding on train, then informant and other Police personnel reached at Barauni railway station, where the train was standing at the platform. On search, accused Pintu Singh was apprehended, who confessed his guilt about his involvement in Mejarganj P.S. Case No. 107 of 2019 and Suppi P.S. Case No. 130 of 2019.

No.13344 of 2020(3) dt.16-06-2020 2/2 He further confessed that the Apache motorcycle bearing registration No. BR-30Q-1482, which is belonging to the petitioner and the pistol used in committing dacoity, are kept at his Dera situated in Shanti Nagar, where he along with petitioner and one Rahul Kumar used to reside. Learned counsel for the petitioner submits that the name of the petitioner surfaced in the confessional statement of co-accused Pintu Singh, who are apprehended in connection with Mejarganj P.S. Case No. 107 of 2019 and Suppi P.S. Case No. 180 of 2019. The petitioner is in custody since 23.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi (Mehsaul O.P) P.S. Case No. 448 of 2019. One of the sureties must be parents/close relative of the petitioner.
