JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2022 Heard Mr. Pankaj Kumar Jha, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Barari (Semapur) Katihar P.S. Case No. 286 of 2020 dated 12.11.2020 instituted for the offences under Sections 307, 386, 427 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioners are said to have fired at the informant when he had gone to his field to plough it by means of tractor. The firing was also aimed at the vehicle. Nobody has been injured in the occurrence.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.25702 of 2021(2) dt.26-05-2022 2/2 that the accusation is absolutely false and is at the instance of local Mukhiya, who has brought the informant into his collusion and has got this false case filed through him. The petitioners are students who have, in the past, tried to expose the misdeeds of the local Mukhiya by filing petitions under the RTI Act. Considering the background facts and taking into account that nobody has been injured in the occurrence, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Barari (Semapur) Katihar P.S. Case No. 286 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
