Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Pramod Kumar Singh, Adv. For the Opposite Party/s : Mr. Anant Kumar(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 2.

12-05-2016 Heard both sides.

The petitioner apprehends his arrest in Tatarpur P.S. Case No. 15/16, G.R. No. 403/16, registered for the offence punishable under Section 392 of the Indian Penal Code. The informant made allegation that the petitioner and others intercepted him and snatched his hard earned money, mobile etc.

Learned counsel for the petitioner Mr. Pramod Kumar Singh submits that the informant is a vendor of Gupchup(an edible item). The petitioner and others went to purchase Gupchup. Some altercation took place over the number of Gupchup consumed and the amount to be paid to the informant and that is why the informant filed the present case against the petitioner and others.

Patna High Court Cr.Misc. No.16507 of 2016 (2) dt.12-05-2016 2/2 He further submits that informant had given the full detail of the petitioner this fact itself shows that the petitioner was well acquainted with the informant from before.

Considering the facts aforesaid and nature of allegation that the petitioner is alleged to have snatched hard earned money of the informant, I am not inclined to enlarge the petitioner on anticipatory bail in Tatarpur P.S. Case No. 15/16, G.R. No. 403/16 pending in the court of Additional Chief Judicial Magistrate, Bhagalpur. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Vinita/- U T
