====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Sri Raj Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 12.04.2018 in Deep Nagar P.S. Case No.03 of 2018 registered for the offence under Sections 30, 30(a) of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail. Learned counsel for the petitioner submits that the petitioner's name has come in the present case in the confessional statement of co-accused, namely, Sri Uday Kumar. He submits that save and except, the confessional statement of co-accused, there is no other material to connect the petitioner. He further submits that co-accused, in whose confession the petitioner's name has come in the present case, has already been granted bail vide Cr.Misc.No.12421 of 2018.

No.28513 of 2018(2) dt.08-05-2018 2/2 Considering the fact that the petitioner's name has come in the confessional statement as well as the fact that accused, in whose confession, the petitioner's name has come in the present case, has already been granted bail, there is no reason to further detain the petitioner. Accordingly, let the petitioner, namely,Rahul Kumar @ Raja be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-VI-cum- Special Judge, Excise Court, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No.3 of 2018 (Rakesh Kumar, J) nawalkrs/- U T
