JUSTICE RAKESH KUMAR ORAL ORDER 26-04-2017 Heard Sri Subhash Kumar Jha, learned counsel for the petitioner and Sri Rishi Raj Sinha, learned Standing Counsel no.19.

The present petition has been filed with a prayer to initiate contempt proceeding against Opp.Parties on an allegation of wilful disobedience to an order dated 14.12.2015 passed in C.W.J.C.No.6617 of 2011. While disposing of the writ petition, this Court had directed the District Education Officer to make payment of due salary of the petitioner to the tune of Rs.61,051 with statutory interest within specified

In this case, earlier a show cause was filed, wherein it was indicated that in compliance with the order of the writ court the amount i.e. Rs.61,051/- was already paid vide Bankers Cheque dated 06.02.2017. Since the cheque amount was without any interest, learned counsel for the State took time for obtaining instruction and filing supplementary show cause. Thereafter, on 19th April, 2017, a supplementary show cause has been filed, wherein it has been indicated that up-todate interest as per direction of this Court was calculated and the same has already been paid. In the supplementary show cause, the fact regarding complete compliance of the order of this Court has been disclosed. Even earlier on 19.04.2017, Sri Rishi Raj Sinha, learned State Counsel had made specific submission.

However, on the prayer of learned counsel for the petitioner, the case was adjourned. Though no reply to the supplementary show cause has been filed by the petitioner, learned counsel for the petitioner tried to persuade the Court that it is not a complete compliance of the order of this Court.
