JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Basantpur P.S. Case No. 25 of 2018, dated 30.01.2018, instituted for the offences under Sections 272, 273, 308, 420, 120-B and 201/34 of the Indian Penal Code and Sections 30(a), 38 and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Several vehicles which were found parked at one particular place were searched and liquor, approximating 3000 litres, was recovered. From one of the vehicles, a document was recovered which indicated that such vehicle had been sold by the petitioner to one Fida Hussain four

Patna High Court CR. MISC. No.16456 of 2019(2) dt.15-03-2019 2/2 years ago. It is on the basis of the aforesaid disclosure of the petitioner being the erstwhile owner of one of the vehicles from where recovery is made, he is being prosecuted.

Considering the aforesaid facts, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II-Cum-Special Judge (Excise), Siwan in connection with Basantpur P.S. Case No. 25 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
