Case diary was called for in the present matter which has since been received.
The petitioner is apprehending his arrest in connection with Hajipur Sadar P.S.Case No. 572/14 registered under Sections 147, 148, 149, 379, 302 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that admittedly there are no eye-witnesses to the occurrence and the entire prosecution story has been built up on conjecture and surmises. Learned counsel further submits that in paragraph-45 of the case diary it has come that both Amarjeet Rai and Birendra Ram had taken liquor and both were quarreling between
Patna High Court Cr.Misc. No.21084 of 2015 (3) dt.29-09-2015 themselves, as a result of which they fell into the pond and died. Learned counsel for the State after perusing the case diary submits that there is no further cogent material so as to implicate the petitioner.
Considering the aforementioned facts and circumstances that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Hajipur Sadar P.S.Case No. 572/14 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
