Petitioner is languishing in judicial custody since 27.03.2018 in connection with Town P.S. Case No. 93 of 2018 for offences punishable under Sections 147, 149, 504, 337, 427, 307, 160, 295A, 353 of the Indian Penal Code.

The prosecution case, as lodged by the police personnel, is that during the occasion of Ramnavmi while procession was being taken out, large number of persons of two communities assaulted each other and number of F.I.R. were lodged against persons of both communities.

It has been submitted by the learned counsel for the petitioner that there was a mob of 150-200 unnamed persons and 28 named persons, both sides resorted to pelting stones and

Patna High Court Cr.Misc. No.28097 of 2018 (2) dt.09-05-2018 2/2 abuses. He submits that some of the persons named in the F.I.R. have already been granted the privilege of bail by co-ordinate Benches of this Court.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Town P.S. Case No. 93 of 2018.
