====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Sikraul P. S. Case No.91 of 2020 instituted for the offences under Sections 323, 353, 307/ 34 of the Indian Penal Code and Section 25(1b)a, 26, 27, 35 of the Arms Act. It is alleged that from the possession of this petitioner, a loaded country-made pistol and a cartridge is said to have recovered.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 26.08.2020 and chargesheet has been submitted in this case. Learned A.P.P. opposes the bail application and

Patna High Court CR. MISC. No.25778 of 2021(2) dt.22-11-2021 2/2 submits that petitioner has criminal antecedents as mentioned in Para-3 of the petition.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri. D. F. Khan, learned Judicial Magistrate, 1st Class, Buxar in connection with Sikraul P. S. Case No.91 of 2020, subject to condition that if the petitioner does not appear before Court below on two consecutive dates, the learned Court below will be at liberty to cancel his bail bonds.

The application stands allowed.
