08-05-2018 Heard Sri Hans Lal Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent, which fact has been stated in paragraph 3 of the petition, has prayed for grant of bail in Bajpatti P.S. Case No. 70 of 2018 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that on false accusation, petitioner was apprehended, as if, petitioner after seeing police party throwing his bicycle loaded with 27 liters of Nepal Saufi wine started fleeing away and he was apprehended.

Be that as it may, considering the nature of accusation

Patna High Court Cr.Misc. No.27875 of 2018(2) dt.08-05-2018 2/2 and clean antecedent, let the petitioner namely Naresh Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bajpatti P.S.
