JUSTICE ARUN KUMAR ORAL ORDER 08-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Baliya PS Case No. 180 of 2017 registered under Sections 302 and 201/34 of the IPC.
The allegation in brief is that the petitioner was married with daughter of the informant eight years back and to realise further dowry the girl was tortured and killed along with one daughter. Learned Counsel for the petitioner submits that the police has submitted charge-sheet under Section 306, 498A and 201/34 IPC, but the fact remains that one surviving daughter of the petitioner was examined who has stated that some foul food was provided by the matter to her which she did not eat therefore she died by committing suicide to falsely implicate the petitioner, the family members as well as this petitioner also had taken meal and the petitioner too was treated for food poisoning. It is further submitted that the lady was of shot temperament, she committed suicide on trivial issue.
Having considered the said facts and circumstances, the petitioner, namely, Shambhu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Begusarai in connection with Baliya PS Case No. 180 of 2017.
