Petitioner, already in custody, seeks bail in connection with Malsalami P.S. Case No. 136 of 2018, registered under Sections 419, 420/34 of the Indian Penal Code, under Sections 7/8 of the Bihar Lottery Act, under Section 11 of the Bengal Gambling Act as well as under Sections 3⁄4 of the Explosive Substance Act.

Allegation in brief is that one Gauri Kumar and other accused, were engaged in gambling and they used to run an organization involved in guessing game.

Learned counsel for the petitioner submits that the kingpin of the gang was Gauri Kumar, he used to run the so called gambling game and the petitioner was an employee and

No.27999 of 2018(2) dt.09-05-2018 2/2 only engaged two days back and he had no knowledge about the scheme of Gauri Kumar and the FIR itself reflects that the petitioner was engaged only two days back and he has no such criminal antecedent except one under Sections 323/504/506 of the Indian Penal Code.

Having considered the aforesaid facts and circumstances, petitioner Randhir Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge, 4th-cum-ACJM, Patna City in connection with Malsalami PS Case No.136 of 2018.
