The petitioner apprehends his arrest in connection with Chandauti P.S. Case no. 254 of 2018, registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The accusation is that petitioner was selected as teacher for Hindi subject by the Chairman-Block Pramukh, Secretary-cum-Block Development Officer, Gaya. According to rule, for Hindi teacher, the candidate should be graduate with Hindi subject, but certificate of the petitioner was found B.Com.

Learned counsel for the petitioner submits that, admittedly, the petitioner is a graduate in B.Com and Hindi was

Patna High Court CR. MISC. No.15050 of 2019(5) dt.19-06-2019 2/2 one of language paper. Moreover, the documents as submitted by the petitioner at the time of selection are not fake and it is the duty of the selecting authority to take care of the rules and regulations.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No. 254 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
