Petitioners apprehend arrest in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 95 of 2022 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. The alleged recovery has been made from an open space situated behind the house of Mahendra Chaudhary as is evident from the seizure list.

Patna High Court CR. MISC. No.16632 of 2022(2) dt.29-04-2022 2/2 Petitioners have no concern with the seized illicit liquor. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of his personal bond to the satisfaction of Exclusive Special Excise Court No. 1, Jehanabad in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 95 of 2022 subject to the conditions laid down under section 438(2) Cr.P.C.
