The learned counsel for the petitioner submits that this is the second attempt of the petitioner to seek bail as earlier his bail application was rejected by order dated 17.01.2022 in Cr. Misc. No.38200 of 2021.

The learned counsel for the petitioner submits that petitioner is in custody since 11.03.2021 and the co-accused have been granted bail subsequently by this Court and by other learned Coordinate Benches of this Court as would be evident from Annexure-3 series.

The learned Additional P. P. does not dispute the fact that similarly situated co-accused have been granted bail by

Patna High Court CR. MISC. No.17052 of 2023(2) dt.05-04-2023 2/2 Annexure-3 series.

Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Sheikhpura in connection with Sessions Trial No.105 of 2022 arising out of Shekhopursarai P. S. Case No.99 of 2020.

The application stands allowed.
