JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with Birpur P.S. Case No. 31 of 2017 registered for offences punishable under sections 304(B), 34 of the Indian Penal Code. Allegation against the petitioner is that she is a mother in law of the deceased and case is of dowry death. Learned counsel for the petitioner submitted that no specific allegation has been attributed rather the allegation is general and omnibus in nature and she is in custody for more than four months.

Heard learned A.P.P. also.

Having heard both sides and considering the aforementioned facts and circumstances, let petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/-

Patna High Court Cr.Misc. No.34914 of 2017 (2) dt.03-08-2017 with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Begusarai, in connection with Birpur P.S. Case No. 31 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not adduce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of her bail.
