JUSTICE ARUN KUMAR ORAL ORDER 08-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.6.2017, seeks bail in Kajraili PS Case No. 23 of 2017 (S.T. No. 149 of 2018) registered under Sections 147, 148, 448, 341, 323, 149, 324, 325, 307, 302, 427 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that the informant's son Himanshu (deceased) had earlier eloped with a girl Sony and in this regard the accused persons including the petitioner had come for panchayati and it is alleged that one Parmanand Yadav assaulted his son Himanshu by Khanti cuasing injury, subsequently assaulted by Bhitto Yadav, when he entered into a shop for rescue then another accused Kusho Yadav, Gokul Yadav, Pankaj Yadav, Arun Yadav, Vivek Yadav, Barun Yadav and Suman Yadav shot at him causing his death.
Learned Counsel for the petitioner submits that there is no accusation against the petitioner of committing any assault against the deceased, he is not related with the family members of the girl rather allegation of committing murder is against Parmanand, Bhitto and other co-accused who shot at him.

No.27919 of 2018 (2) dt.08-05-2018 Having considered the aforesaid facts and circumstances as there is no specific accusation against the petitioner of assaulting the deceased or opening fire and he has no criminal antecedent, so the petitioner namely, Ashok Yadav @ Adhik Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge V, Bhagalpur in connection with Kajraili PS Case No. 23 of 2017, S.T.
