The petitioner apprehends his arrest in a case in connection with C.R. Case No.225/2019, registered for the offence punishable under Sections 341, 323, 384, 420, 467, 468, 471, 472, 406 of the Indian Penal Code.
The allegation against the petitioner is of committing forgery with the complainant, in the name of managing appointment letter for his sons.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence as
Patna High Court CR. MISC. No.20785 of 2020(4) dt.21-12-2021 2/3 alleged has ever taken place. The allegation leveled upon the petitioner is not specific rather general and omnibus in nature. The specific allegation is against co-accused Ramsogarat Yadav. There is no any document relating to the transfer of money. Petitioner has one criminal antecedent, which is also mentioned in para-3 of the bail application.
Learned counsel for the State as well as learned counsel for the complainant/informant have opposed the prayer for bail by submitting that the petitioner and other co-accused Ramsogart Yadav have taken Rs.13 Lakhs from the complainant to given appointment letter to the complainant's sons but neither the appointment letter was given nor the money was returned.
Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner is hereby rejected.
Accordingly, the instant anticipatory bail application is dismissed.
However, the petitioner is directed to surrender before the learned court below within a period of four weeks and seek regular bail.
