Mr. DINESH SINGH ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 272, 273 and 120B of the Indian Penal Code and Sections 30 (a)/38(2)/41(1)(2) and 47 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 1762 litres 500 Ml. of foreign liquor were recovered from the hut. Petitioners claim that they were neither arrested on spot nor were anything recovered from their possession rather they have been implicated in the present case on disclosure of their names by apprehended co-accused. Petitioners claim that they are

Patna High Court Cr.Misc. No.46728 of 2017(2) dt.21-09-2017 2/2 having clean antecedent and are in custody since 2.7.2017. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna, in connection with Special Case No. 3289/2017 arising out of Kotwali P.S. Case No. 317 of 2017.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
