The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 8/20/22 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that police has recovered 8.5 kg Ganja from the possession of the petitioner which is less than commercial quantity. He further submits that petitioner bears five criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 16.06.2020. Considering the facts and circumstances of the case as well as the period of custody and the fact that recovered contraband article is less than commercial quantity, let the

Case No. 59 of 2020, subject to the condition that the petitioner will mark his attendance in the local police station in the first week of every month till conclusion of trial, failing which the prosecution will be at liberty to move cancellation of his bail bond.
