The petitioner seeks bail in connection with Nayagaon P.S. Case No. 28/2017 dated 19.06.2017 instituted for the offence under Section 392 of the Indian Penal.
The informant was waylaid by three miscreants and was divested of Rs. 61,265/-. Later, one of the passers-by/Cyclist and one Hareram who arrived later disclosed the name of one of the miscreants as Vikash Kumar (the petitioner).
From perusal of the F.I.R., it is not clear that the occurrence was witnessed by the Cyclist referred to above or Hareram Singh. Nothing has been recovered from the possession of the petitioner. The petitioner, however, has made his confessional statement before the police.
Patna High Court Cr.Misc. No.48020 of 2017 (3) dt.28-11-2017 2/2 Taking into account the custody of the petitioner which is from 22.07.2017 and the fact that the petitioner does not bear any criminal antecedent, this Court is inclined to grant bail to the petitioner.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Begusarai in connection with Nayagaon P.S.
