2. The petitioner apprehends his arrest in a case registered for the offence under Sections 366A and 34 of the Indian Penal Code and Sections 8 and 10 of the POCSO Act.

3. It is alleged that this petitioner alongwith other F.I.R. named co-accused kidnapped 13 years old minor daughter of the informant for the purpose of marriage.

4. The victim, in her statement recorded under Section 164 Cr.P.C., has denied the prosecution case and has categorically stated that no one has kidnapped her and she voluntarily left the house out of anger with her mother. Coaccused Manoj Kumar @ Manoj Ram, with similar allegation, has already been allowed pre-arrest bail by this Court vide order passed in Cr.Mis.No. 29075/2023.

5. Learned counsel for the State opposes the prayer for bail.

5. Considering the statement of the victim recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of

Patna High Court CR. MISC. No.18219 of 2024(5) dt.29-11-2024 2/2 petitioner is allowed. In the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th A.D.J.-cum-Special Judge, POCSO, Motihari, East Champaran in connection with Harsidhi P.S.
