The petitioner seeks bail in Ujiyarpur P.S. Case No. 116 of 2020, registered for the offence punishable under Section 363, 366, 366A/34 of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 13.04.2021. It is submitted that during trial prosecutrix was examined as PW-3 and she has completely denied the prosecution case. Similarly father (PW-1) and mother (PW-2) of the victim girl have also not supported the prosecution case. Petitioner claims clean antecedent and he is in custody since 04.05.2020.

Considering the deposition of prosecutrix (PW-3) and period of custody, the petitioner above-named, is directed to be

Patna High Court CR. MISC. No.15405 of 2022(2) dt.30-03-2022 2/2 enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cumSpecial Judge (POCSO), Samastipur in connection with Ujiyarpur P.S. Case No. 116 of 2020.
