JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case filed with accusation under Sections 323,324,341 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act wherein process has been directed to be issued after cognizance being taken.
The prosecution case is that the complainant went to the house of the accused persons for demanding due wages of rupees thirty thousand when the complainant was abused by calling caste name and assaulted with fists and slaps.

No.17455 of 2016 (2) dt.25-04-2016 2/2 It is submitted by the learned counsel for the petitioner that in the background of wages dispute between the parties the accusation has been levelled. It is further submitted that admittedly the occurrence took place in the house of the accused persons which cannot be treated as public view and for the occurrence of 16.11.2014 the complaint was filed on 22.11.2014. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM II, Begusarai in connection with Complaint Case No. 15475 C of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
