====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 01.09.2018 in a case for the offence registered under Sections 341, 323, 307/34 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that on 24.08.2018 at about 8.30 P.M., the informant was returning to his house by Motorcycle and as soon as he reached near garden of VillageBakhariya, two persons surrounded him. Out of them, one is petitioner and other was unknown. The petitioner fired upon the informant which hit in the stomach of the informant and other co-accused assaulted him with Bamboo (Danda) but anyhow he fled away.

It has been submitted by learned counsel for the

Patna High Court CR. MISC. No.14628 of 2019(3) dt.15-04-2019 2/2 petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. There is no substantive evidence to suggest the implication of the petitioner in the present case. It is further submitted that the petitioner may be released on bail after completion of nine months in custody.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R/ complaint case.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of nine months in custody on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhojpur at Ara, in connection with Ara Mufasil P.S. Case No. 277 of 2018. (Sudhir Singh, J) U.K./- U T
