ANJANA MISHRA ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.10.2017 in connection with Kadwa P.S. Case No.161 of 2017 (G.R. No.2556 of 2017) registered for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the present petitioner did not figure in the F.I.R., but only on the basis of confessional statement made before the police by a co-accused, the petitioner has been roped in connection with the present case. It is further submitted that till date, no incriminating material has been recovered from the possession of the petitioner nor has he been placed on T.I.

However, in view of the aforementioned facts and circumstances and that the petitioner has already been in jail for more than six months, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Katihar, in connection with Kadwa P.S. Case No.161 of 2017 (G.R. No.2556 of 2017).
