Though, the learned counsel for the applicant argued that the seizure list was prepared first and the FIR was prepared subsequently so also that there are no independent Panchas to the seizure list, considering the fact that it is chance recovery of 12.24 kilogrames material which is said to be Ganja by the prosecuting agency, I am not inclined to release the applicant on bail at this stage. The learned APP submits that as yet report of FSL is not received.

Considering the quantity of the contraband and the recitals in the FIR, no case for grant of bail is made out at this stage. The application is therefore, rejected with

Patna High Court CR. MISC. No.25965 of 2021(2) dt.08-12-2021 2/2 liberty to the applicant to renew the request after receipt of the report from the FSL.
